By visiting or using the Pathos X websites, including DecodifyAI, you agree to be bound by these Terms of Use. If you do not agree, you should discontinue use of our site and services immediately. Pathos X may revise these Terms from time to time. Your continued use after changes are posted constitutes your acceptance of the updated terms.

Adult Use Only: DecodifyAI is intended for individuals aged 18 and older. By accessing or using the service, you confirm that you are at least 18 years of age.

No Analysis of Minors: You may not submit, upload, or analyze communications, behavior, or other expressions from anyone under 18. Use of DecodifyAI by parents, guardians,  or others to evaluate minors is strictly prohibited.

Inputs You Provide: You must not upload, submit, or otherwise provide content to DecodifyAI that is sexually explicit, graphically violent, exploitative, or illegal. Submitting prohibited material may result in immediate suspension or termination of access.

Crisis and Safety Content: You may not submit or analyze content expressing or depicting suicidal, self-harming, or homicidal thoughts, threats, or actions. DecodifyAI is not designed to assess or intervene in such situations. If you or someone you know is in crisis, you must contact emergency services or a qualified crisis hotline.

‍Emergency Situations: DecodifyAI does not provide emergency response. If you are experiencing or witnessing a crisis, you must contact local law enforcement or emergency services immediately.

DecodifyAI relies on artificial intelligence to generate insights, responses, and analyses. While advanced, AI technology is not error-free. Outputs may be incomplete, inaccurate, or misleading.

‍Informational Only: All content - text, graphics, AI outputs, and resources - is provided for general informational purposes.

‍Not Professional Advice:  Nothing on the site should replace professional legal, medical,     psychological, financial, or other expert guidance.

‍Critical Evaluation: You are responsible for evaluating the accuracy and usefulness of AI-generated content. Pathos X is not liable for reliance on such content. If you face an emergency or require professional help, you must contact qualified professionals or emergency services. DecodifyAI is not designed to provide crisis intervention.

Assumption of Risk: Pathos X does not assume responsibility for user-submitted content or for any actions you take (or fail to take) in response to DecodifyAI outputs. By using DecodifyAI, you accept full responsibility for your actions and their consequences.

Users agree to engage responsibly. You are solely responsible for ensuring that your use of the site complies with all laws applicable to you, whether local, state, federal, or international.

User Account Security: Users are responsible for maintaining the confidentiality of login credentials and keeping accounts secure. You are responsible for all activities under your account.

Illegal Activities: Fraud or violating laws.
Harmful Intent: Harassment, discrimination, or slander.
Inappropriate Content: Uploading unlawful, exploitative, or misleading material.
Reverse Engineering: Copying or altering software code or algorithms.
Spamming: Distributing malicious content or phishing.
Circumvention: Bypassing security measures or exploiting vulnerabilities.
IP Infringement: Infringing on intellectual property or privacy rights.
Data Exploitation: Misusing others' data without consent.
Automated Access: Using bots or scrapers without authorization.
Competitive Misuse: Developing competing products using our platform.
Disruption: Overloading infrastructure or conducting DDoS attacks.

Failure to comply with applicable laws or these Terms may result in suspension or termination of access, and Pathos X reserves the right to report violations to authorities.

Pathos X strictly prohibits the use of its services to violate inherent human rights. Users must not engage in activities that promote discrimination, harassment, exploitation, or harm. Violations may result in immediate suspension or termination. Reports can be submitted to report-misuse@pathos-x.com.

‍Pathos X retains ownership of the DecodifyAI software, algorithms, and all underlying intellectual property. Users are granted a limited, non-exclusive license to use DecodifyAI in accordance with these Terms.

User Submissions: You retain all rights to the media, text, or other material you submit to DecodifyAI. By submitting content, you grant PathosX a limited license to process and analyze your submissions for the purpose of providing the DecodifyAI service.

‍DecodifyAI Outputs: Analyses, ratings, visualizations, and other outputs generated by DecodifyAI are proprietary to Pathos X. You are granted a limited license to download, share, and display DecodifyAI outputs for personal use, commentary, and non-commercial distribution (including on social media platforms), provided that attribution to DecodifyAI is preserved and not removed, obscured, or altered.

‍Commercial Use: Any commercial use, republication, or redistribution of DecodifyAI outputs outside of personal or editorial sharing requires prior written permission from Pathos X.

‍Branding: DecodifyAI outputs may include trademarks, logos, or watermarks of Pathos X. Users agree not to remove, obscure, or modify such branding.

‍Third-Party Rights: You are solely responsible for ensuring you have the necessary rights to any third-party content you submit to DecodifyAI and for how you choose to distribute outputs that reference such content. Pathos X disclaims responsibility for unauthorized use of third-party content by users.

Conditioned on Compliance: Licenses and sharing rights are subject to your compliance with these Terms, including the Age Restrictions and Prohibited Uses sections.

As an individual or enterprise user, your data and DecodifyAI's analyses and ratings will remain private to you. Pathos X does not, and will never utilize user data for LLM training. Refer to our Privacy Policy for details.

Users are offered a free account with a lifetime limit of 50 credits. Payments are processed securely via Stripe.

Refund Policy: Free credits are non-refundable. For paid subscriptions, refunds for unused credits are available within 7 days of purchase. Users may request a refund at help@pathos-x.com.

Pathos X may update, suspend, or remove features, services, or content at its discretion. The websites and DecodifyAI services are provided "as is" and "as available." Pathos X, its licensors, and its suppliers disclaim all warranties - express, implied, or statutory - including but not limited to:

🔹 Fitness for a particular purpose
🔹 Non-infringement
🔹 Accuracy
🔹 Timeliness
🔹 Reliability of content

We do not guarantee uninterrupted or error-free operation, nor that the site will be free from security risks or harmful components.

Pathos X takes reasonable measures to protect its systems, but no platform is completely secure. Users accept the risk of unauthorized access, data breaches, or technical failures. You are responsible for safeguarding your own systems and data (e.g., using secure passwords, antivirus software, and secure networks). Pathos X disclaims liability for losses arising from security incidents.

To the maximum extent permitted by law:

🔹 Pathos X, its affiliates, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of or inability to use the site, the DecodifyAI service, or any content. This includes, without limitation, damages for loss of profits, data, goodwill, business interruption, or other intangible losses, even if Pathos X has been advised of the possibility of such damages.

🔹 Pathos X’s total liability for any and all claims arising out of or related to these Terms or your use of DecodifyAI shall not exceed the greater of:
(a) the total amount you paid to Pathos X for use of DecodifyAI in the twelve (12) months immediately preceding the event giving rise to the claim, or
(b) one hundred U.S. dollars (USD $100).

🔹 Some jurisdictions do not allow limitations of liability for certain types of damages. In such cases, Pathos X’s liability will be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Pathos X, its officers, employees, contractors, and affiliates from claims, liabilities, damages, costs, and expenses (including legal fees) arising from:

🔹 Your misuse of the site or DecodifyAI
🔹 Content you submit or share
🔹 Violation of intellectual property or privacy rights
🔹 Breach of these Terms or applicable laws

You also agree to cooperate in the defense of such claims.

These Terms are governed by the laws of the State of Florida, U.S., without regard to conflict of law rules.

Informal Resolution
‍Before initiating arbitration, you agree to first contact Pathos X at operations@pathos-x.com to attempt to resolve the dispute informally. Most concerns can be quickly resolved this way.

Binding Arbitration
If the parties cannot resolve the dispute within thirty (30) days, the matter shall be submitted to final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration may be conducted in Tampa, Florida, or virtually by mutual agreement.

‍Class Action Waiver
All disputes must be brought on an individual basis. You and Pathos X agree that neither may bring a claim as a class, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

‍Exceptions
The obligation to arbitrate does not apply to:

🔹 Intellectual Property Disputes: Pathos X may bring actions in court to protect or enforce intellectual property rights (e.g., trademarks, copyrights, trade secrets).

🔹 Small Claims Court: Either party may pursue an individual claim in small claims court for disputes within the jurisdictional limits of that court.

‍Finality
The arbitrator’s decision will be binding and may be entered as a judgment in any court with competent jurisdiction.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force. Any invalid portion will be replaced with a valid provision that most closely reflects the intent of the original.

These Terms of Use constitute the entire agreement between you and Pathos X regarding DecodifyAI and supersede all prior agreements, whether written or oral, on the same subject matter.
